Gjykata e Apelit e Juridiksionit të Përgjithshëm la në fuqi vendimin e Gjykatës së Shkallës së Parë, e cila kishte rrëzuar kërkesën e Prokurorisë për pushimin e procedimit penal për vdekjen e 28-vjeçarit Jani Rustemi. Sipas vendimit, hetimet nuk ishin të plota dhe duhet të vijojnë të thellohen, duke plotësuar detyrat e lëna nga Gjykata e Shkallës së Parë, për të përcaktuar nëse ka pasur neglizhencë në trajtimin mjekësor, të verifikohet mosakomodimi i tij në IEVP pas caktimit të masës së sigurimit dhe sqarimi i rrethanave të trajtimit gjatë qëndrimit në Bllokun e Sigurisë e më pas në QSUT. Gjykata e Lartë konstaton shkeljen e afatit të arsyeshëm të një procesi të zgjatur padrejtësisht prej vitesh! ⚖️ Gjykata e Lartë ka pranuar kërkesën e shtetasve G.J. dhe F.J. përfaqësuar nga avokatët e Qendrës “Centre for Legal Empowerment”, duke konstatuar shkeljen e afatit të arsyeshëm nga Gjykata Administrative e Apelit Tiranë. 📌 Kërkuesit iniciuan çështjen gjyqësore në vitin 2016 pranë Gjykatës Administrative të Shkallës së Parë duke kërkuar shpërblim për dëmin pasuror dhe jopasuror të shkaktuar nga prishja e paligjshme e banesës së tyre. Gjykata vendosi pranimin e pjesshëm të padisë dhe detyrimin për ti shpërblyer dëmin pasuror në vlerën 3 485 000 lekë dhe dëmin moral në vlerën 300.000 lekë për dëmin e shkaktuar. Ky vendim u ankimua dhe megjithëse kanë kaluar gati 5 vite, ende nuk është caktuar një datë gjykimi nga Gjykata Administrative e Apelit Tiranë, duke cënuar të drejtën për gjykim brenda një afati të arsyeshëm. Pavarësisht se pala kërkuese ka paraqitur kërkesa për përshpejtimin e gjykimit të çështjes, gjykata nuk ka shqyrtuar çështjen, duke cënuar kështu të drejtën e kërkuesve për një gjykim brenda një afati të arsyeshëm.

Si mund të rrisim transparencën, llogaridhënien dhe përfshirjen e publikut në kontratat e Partneritetit Publik-Privat (PPP)? Kjo është pyetja udhëheqëse pas të cilës po hidhen hapat e parë drejt ngritjes së Observatorit të Kontratave Publike, një nismë për të fuqizuar qytetarët, gazetarët dhe shoqërinë civile që të monitorojnë me më shumë efikasitet kontratat publike. Manuali i ri i trajnimit, i zhvilluar në kuadër të projektit “Building Sustainable Monitoring Capacity for Public Contracts”, mbështetur nga Ministria e Punëve të Jashtme e Holandës në kuadër të programit MATRA 2024, është një hap konkret drejt këtij qëllimi. Ai ofron një udhëzues praktik për të: ➡️Kuptuar dallimin mes PPP-ve dhe prokurimeve publike ➡️Njohur procedurat ligjore dhe institucionale për lidhjen e PPP-ve ➡️Monitoruar zbatimin dhe cilësinë e shërbimeve të kontraktuara ➡️Përdorur të drejtën për informim për të kërkuar transparencë dhe llogaridhënie Observatori i ardhshëm do të ndërtohet mbi këto baza: njohuri, monitorim dhe veprim qytetar.
